How to report alleged copyright infringement on 3Tej, and how to file a counter-notification, under 17 U.S.C. § 512.

All notices and counter-notifications should be sent to 3Tej's designated agent at hi@3tej.com. Put "DMCA Notice" or "DMCA Counter-Notice" in the subject line. Notices that don't meet the requirements below may not be acted on.

Our position

3Tej respects intellectual property and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on the Site infringes a copyright you own or control, follow the procedure below. We respond to properly submitted notices promptly.

We may also remove or disable access to content if we have actual knowledge or awareness of facts and circumstances that make infringement apparent.

Filing a takedown notice

To submit a notice under 17 U.S.C. § 512(c)(3), email our designated agent (above) a written communication including all of the following. Missing elements may result in the notice being rejected.

  1. A physical or electronic signature of a person authorised to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list.
  3. Identification of the material claimed to be infringing or the subject of infringing activity that is to be removed or disabled, with information reasonably sufficient to permit us to locate it - ideally the full URL on 3tej.com.
  4. Information reasonably sufficient to permit us to contact you, such as address, telephone number, and email.
  5. A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Misrepresentations in a takedown notice may subject you to liability under 17 U.S.C. § 512(f). Submit deliberately false notices and you may owe damages. Consider whether the use is a fair use, licensed, or otherwise authorised before sending.

What happens after we receive a valid notice

If the notice substantially complies with 17 U.S.C. § 512(c)(3):

  • We remove or disable access to the identified material expeditiously.
  • We notify the user who posted the material (where there is one) of the takedown.
  • We retain the notice in our records and may forward to upstream providers when relevant.

Counter-notification

If your content was removed and you believe in good faith that it was removed by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3). Email it to the designated agent with the following elements:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which 3Tej may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.

If we receive a valid counter-notification, we may forward a copy to the original notifier and may restore the removed material in 10 to 14 business days, unless we first receive notice that the notifier has filed an action seeking a court order to restrain the user.

Repeat infringer policy

In accordance with the DMCA and other applicable law, 3Tej has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. While 3Tej does not currently host third-party user uploads at scale, this policy applies prospectively to any contributor account, comment section, or future user-generated feature that may be added.

Misuse

The DMCA process exists to address genuine copyright infringement. Sending knowingly false notices, using the DMCA to suppress lawful speech (fair use, criticism, commentary, parody), or filing claims you do not have standing to file may result in liability and is contrary to public interest. We reserve the right to flag, retain, and publicly reference notices we believe to be abusive.

Other intellectual property concerns

For trademark or other intellectual property issues not covered by the DMCA, email the same address with a clear subject line (e.g. "Trademark concern"). Include a description of the right asserted, evidence of ownership, the specific page on 3Tej involved, and the resolution you're requesting.

Note on legal advice

The DMCA is procedural. Whether a particular use is or is not infringing is a legal question often turning on fair use, licence scope, or jurisdiction. This page is not legal advice. If you're unsure whether to file a notice or counter-notice, consult a copyright lawyer.
